Swier Law Firm recently secured a favorable jury verdict for its client against B-Y Water District in Bon Homme County Circuit Court.
The current worship building for Martinus Lutheran Church in Utica, South Dakota, is almost ninety (90) years old. Adjacent to the church building is the parsonage. For decades, B-Y Water District had supplied water to the church building and the parsonage.
In 1979, Minnie Schenkel purchased the parsonage from the church. After Minnie purchased the parsonage, B-Y Water District continued to supply water to her home. However, in 2013, B-Y Water District abruptly informed Minnie that it was going to discontinue all water supply to her home. At trial, a Bon Homme County jury found that Minnie had an implied contract and B-Y Water District could not simply stop supplying water to her home.
