Supreme Court Strikes Down Recreational Marijuana

 

The South Dakota Supreme Court ruled Wednesday that a voter-approved constitutional amendment to legalize recreational marijuana is unconstitutional, upholding an earlier decision by the state’s sixth circuit court.

 

In a 4 to 1 vote, the Court determined that the constitutional amendment dealt with three separate and distinct subjects, those being recreational marijuana, hemp and medicinal marijuana.
