South Dakota Federal Court Declines To Dismiss Case In Tubing Mishap At Ski Resort

 

A federal judge has cleared the way for a jury to decide whether the owners of a ski resort and tubing hill were negligent in an accident that left a 7-year-old girl with a severe head injury.

The girl was injured on March 13, 2015 while tubing at Mystic Miner near Lead, South Dakota, when her tube stopped in the middle of the run, and she was hit by another tuber. She suffered a fractured skull and was flown to a Colorado hospital where she underwent an emergency craniotomy.
