On August 10, 2017, Scott Swier addressed the Associated School Boards of South Dakota/School Administrators of South Dakota Convention in Sioux Falls.
Scott's presentation - "A Roadmap for South Dakota's School Districts in Title IX Disputes" - reviewed Title IX lawsuits based on claims of sexual harassment/assault which have received heightened attention over the past several years. Title IX liability for public school districts for student claims of sexual harassment/assault has been, and continues to be, a hotly litigated area of education law. With the focus being given to these issues by the media, school districts will see more Title IX lawsuits by students alleging student-on-student and staff-on-student sexual harassment and violence. Scott's presentation provided a roadmap for defending Title IX disputes, specifically related to claims for sexual harassment/assault.
